Parish Council playground meeting - VA Statement

The VA and CBCT were invited to attend the Parish Council meeting on 25th January. There were about 15 residents attending including most of the VA directors - however CBCT had declined the invitation.
The Parish Council asked the VA for an update on the transfer of the childrens playground to the Council. Paul Pozzoni presented the situation on behalf of the Village Association and explained that the VA had signed and delivered the legal documents to the Tandridge solicitor by 1st of December. The solicitor was present and he confirmed that.
The VA also explained that CBCT had told them on 22nd December, via their solicitor, that they were no longer proceeding with the transfer of the playground alone as they had previously agreed to in May.
Instead, CBCT now want changes to some conditions set out in the transfers of the freehold relating to other public assets (Arc, Green and Pavilion, Rifle Ranges etc). These are historical conditions that are in place to protect residents. The changes proposed by CBCT now seem to be a new pre-condition of transferring the playground.
The VA advised the PC during the meeting, and have advised CBCT direct, that they cannot recommend the residents accept a watering down of those clauses protecting all residents over future uses, repairing responsibilities etc without specific proposals to consider so that the VA can assess what impact any future changes might have on the residents of The Village.
The VA continues to seek a face to face meeting with CBCT and plan to hold a VA members meeting to explain all this face to face with residents during March.
The VA directors have decided that in view of the continuing delay over this matter, that for 2017, the on-going maintenance payments made to CBCT are to be delayed as the Rent Charge Deed allows the VA to do.
